1. Acceptance of Terms
By accessing and using Decking Earth's services, you accept and agree to be bound by the terms and provision of this agreement.
2. Services Description
Decking Earth provides professional decking design, installation, and maintenance services for residential and commercial properties throughout South Africa.
Our services include but are not limited to:
- Custom deck design and consultation
- Professional deck installation
- Deck maintenance and repairs
- 3D visualization and planning
- Sustainable material sourcing
3. Client Responsibilities
As a client, you agree to:
- Provide accurate information about your project requirements
- Ensure site access for our team during scheduled work hours
- Make timely payments as outlined in your service agreement
- Inform us of any site-specific conditions or restrictions
- Maintain the deck according to our care guidelines
2. Payment Terms
Payment terms are as follows:
- 50% deposit required to commence work
- 40% payment upon completion of installation
- 10% final payment upon client satisfaction and project handover
- All payments are due within 7 days of invoicing
- Late payments may incur interest at 2% per month
5. Warranty and Guarantees
We stand behind our work with the following guarantees:
- 5-year workmanship warranty on all installations
- Material warranties vary by manufacturer (typically 10-25 years)
- Warranty covers defects in materials and workmanship
- Warranty does not cover damage from misuse, neglect, or extreme weather
6. Cancellation Policy
Project cancellations must be made in writing:
- Cancellations 14+ days before start: Full deposit refund
- Cancellations 7-13 days before start: 50% deposit refund
- Cancellations less than 7 days before start: No refund
- Cancellations after work commencement: No refund, payment for completed work required
7. Limitation of Liability
Decking Earth's liability is limited to the cost of services provided. We are not liable for:
- Consequential damages or loss of use
- Damage from improper maintenance by client
- Acts of nature or extreme weather events
- Issues arising from client-provided materials or existing site conditions
8. Force Majeure
We are not liable for delays or failures in performance due to circumstances beyond our reasonable control, including but not limited to: weather events, material shortages, labor disputes, or government restrictions.
9. Dispute Resolution
Any disputes arising from our services will be resolved through good faith negotiation. If unresolved, disputes will be mediated through an independent mediator before pursuing legal action.
10. Changes to Terms
Decking Earth reserves the right to modify these terms at any time. Changes will be effective immediately upon posting to our website. Continued use of our services constitutes acceptance of any modified terms.
